Wash. court reins in warrantless car searches

The state Supreme Court says police were wrong to search a man's car after arresting him at home, even though he was standing next to the car with his head ducked in the window when the authorities arrived.

  1. I completely agree with the Washington state Supreme Court in this case. I have never agreed with the constitutionality of police officers being allowed to search a vehicle not turned on or being driven at the time of the search without a search warrant. I feel even more strongly regarding a vehicle parked on one's own property. It is a completely different story if one is driving down the road and looks suspicious--police officers need to act immediately in these cases to maintain public safety. My feeling is, however, that if one is not safe from search and seizurewithout a warrant on one's own property, then the constitution is not being upheld in this country.

  2. I also agree with the Washington State Supreme Court because the police did not have any reason to search the car, it was on personal property, not being driven and no warrant. They went around the law just because they felt they could due to the them being able to legally search vehicles, which doesn't seem right at all unless a warrant is issued, except this was not legal.
