Paralegal Fights Search of His Home Over Twitter Tweets About Police Activities

A case about a paralegal who is facing charges for using Twitter to tell protesters to stay away from areas which had police presence during the G-20 summit protests. I am definitely going to do some more research to look into the legal issues of using a police scanner but it seems like a very interesting case.
Does anyone know about the legal issues of using police scanners?

  1. That's crazy, can someone listen to a police scanner who isn't a police officer for one and two can can they tell people not to go to certain areas because it had police presence in the G-20 summit protests. That is completely crazy. I think there are laws against listening to a police scanner I am just not sure what they are.

  2. I did a little bit of research (I couldn't find that much) and found that scanner usage is generally regulated differently from state to state. However, it is a federal crime to monitor cellular telephone calls so any scanners that can be modified to do so are illegal. Otherwise all I can find is that it is a generally followed principal that police scanners cannot be used to aid in the commission of a crime and the information overheard on a scanner cannot be disclosed to other persons. I can't find any laws or concrete answers though.
