Judge Vacates $1.26 Billion Ruling Against PepsiCo

In a follow up to the PepsiCo case in which a judge ordered PepsiCo to pay $1.26 billion to two Wisconsin men who claimed that PepsiCo had stolen trade secrets and their idea for fullbottled water, the original decision has been overturned. The Wisconsin men were awarded the default judgement because PepsiCo did not respond to the charges. PepsiCo argued that they were unaware that the case had been filed because a secretary had not given letters about the case to the proper people. PepsiCo also argued that the case should have been filed at its headquarters in Purchase, NY and not in North Carolina where the company is incorporated.

  1. How could Pepsi have not known what was going on? Why would a secretary not give the bosses letters about a case being filed against them? I agree with Pepsi in they the case should have been filed at its headquarters but that doesn't mean they totally had no idea whatsoever.

  2. i found this very interesting. And i have to think really clearly on this one, because of the reason on which pepsi did not say anyhting back to the judge about the situation. I think personally that the woman whom did not give pepsi the case was in on it with gentlemen. But pepsi i thinkis right about the case being settles in the place in which they are incorporated. I hope everything goes in pepsi's favor.
