Gay Marriage Foes Win Some Satisfaction From 9th Circuit

In California, judges and politicians are weighing heavy on the resolution of proposition 8, which would legal ban same sex marriage. The proposition asserts that marriage is traditionally between a man and a woman, and so it should remain. This, however, is an invalid argument on the grounds that it commits the fallacy of "appeal to tradition" and, as many of its opponents would argue, is unconstitutional. Currently, proposition 8 is being brought to decision in California's 9th Circuit, where judges of the Circuit's Appeals Court are motioning for a discovery of some Yes camp members' emails to determine if there is a discriminatory nature behind the proposition. At the moment, proponents of the proposition are hard pressed to find any conclusive, secular reason for the banning of same sex marriage, which has lead some to believe that this proposition comes purely from a religious stand point.

  1. I don't understand how or why any government would feel the need to revoke the marriage rights of anyone (straight/gay/lesbian/whatever). Homosexuality may be considered a "sin" in the bible but we have a little thing called separation of church and state......
